Options for Legacy Giving Include:
This is the easiest and most common way to provide end-of-life giving. Simply name Aurora Mental Health & Recovery as a beneficiary in your will with a percent or dollar amount that you would like to leave for countless others to receive the care that they need. This type of gift is non-taxable, helping to make the most of your generous gift.
This is an irrevocable trust, meaning it is unable to be modified or cancelled/terminated after its creation. In this kind of giving, you, the donor, make several donations over a set period of time after you have completed funding the trust. There is typically no capital-gains tax on the appreciation of the trust. There are two different options for a charitable trust detailed below.
Charitable Lead Trust (CLT)
With a CLT, you, the donor, fund cash or assets for a set period of time. You can use this funding to “reduce” your annual gross income (AGI) by the amount being sent to the trust, creating a tax deduction. However, you will owe tax upon your final payout from the trust back to you or your beneficiaries. Your other option is to not take the funding-period tax-cut and receive it later upon the trust’s final payout to you or your beneficiaries. Ask your tax advisor which option is best for you.
After the funding period has completed, the trust will then make donations annually (or whatever interval you choose) to AMHR for a set period of time specified during its creation. After this term, all remaining funds in the trust will be distributed back to you, the donor, or your beneficiaries. As mentioned above, this payout may be taxable.
Charitable Remainder Trust (CRT)
With a CRT, you, the donor, fund cash or assets for a set period of time. You can use this funding to “reduce” your annual gross income (AGI) by the amount being sent to the trust, creating a tax deduction. However, you will owe tax upon your payouts back to yourself or your beneficiaries. Your other option is to not take the funding-period tax cut and receive it later upon the trust’s final payout to AMHR. Ask your tax advisor which option is best for you.
After the funding period is completed, the trust will then make payments back to you, the donor, or your beneficiaries for a set period of time. This can either be the donor/beneficiary’s lifetime or up to 20 years. Payments from the trust are a set percentage of 5–50% of the value of the trust upon its final established amount and may be taxable as income.
After this term, the remaining funds will be distributed to AMHR. This amount must be at least 10% of the original trust value. With this kind of trust, the benefiting charities can be modified after the initial setup of the trust.
In this kind of giving, you simply name Aurora Mental Health & Recovery as a/the beneficiary on your life insurance policy. Upon your death, your estate will be entitled to a tax deduction equal to the amount transferred to AMHR and the amount of your policy will not be subject to estate tax. This tax benefit is called a Charitable Estate Tax Deduction. You have two designation options for this kind of giving.
Revocable Beneficiary Designation
With this designation, you, the donor, maintain ownership over your policy. You will not receive an income tax deduction, as this is considered a future gift and, as such, can be revoked.
Irrevocable Beneficiary Designation
With this designation, you, the donor, irrevocably transfer all rights and incidents of ownership, current and future, in your policy to AMHR. You will receive an income tax deduction on the amount in your policy.
To donate your retirement account, name Aurora Mental Health & Recovery as your beneficiary on your designated beneficiary form. Your retirement account funds will be directly transferred to AMHR upon your death, free of tax deductions. The amount donated will be included in your gross estate but is non-taxable, and your estate will receive a tax deduction for this amount.
If you are 70.5 years of age or more, you can donate up to $100,000 from your Individual Retirement Arrangement (IRA) directly to AMHR and avoid income tax on the amount transferred. This is called a Qualified Charitable Distribution. This is for IRAs only and is a way to give to AMHR while you are still alive.
To give gifts of real estate, name Aurora Mental Health & Recovery as the beneficiary of a specific piece of property (land, building(s), vehicles) and it will be signed over to AMHR upon your death. By donating real estate directly, you cut out the capital gains tax from selling the property and then donate the proceeds, thereby making the most of your gift.
By making a gift of stock, you avoid capital gains tax and receive a tax deduction on the amount you donated. This will also make the most of your gift by providing AMHR with 20–37% more of your gift than selling and donating the proceeds. You can donate publicly traded stocks, privately held stocks (which will require independent appraisals beforehand), shares of mutual funds and Exchange-Traded Funds (ETFs), and/or bonds. To do so, simply fill out a stock transfer form from your brokerage.
